These Terms of Service (“Terms”) are between Resonate Tech., Inc. (“AIssistify”) and you (“Customer”). The Terms govern your use of AIssistify’s SaaS services, including the AI-powered content generation service (the “Service”).
Customer may access and use the Service in accordance with the features and functionalities of the plan to which they have subscribed (Professional, Professional Plus, or Enterprise), as described on AIssistify’s website and in Section 3 of these Terms. Each plan is allocated a certain number of tokens corresponding to AI actions. The Customer shall not misuse the Service, including but not limited to, attempting to access or use the Service in a manner not authorized by these Terms or AIssistify’s then-current policies.
The Service integrates with HubSpot and is contingent upon the Customer having an active subscription to one of the HubSpot hubs. Customer's use of the Service through HubSpot is subject to HubSpot’s terms of service and privacy policy.
The Service is offered in the following subscription plans:
Professional Plan: $49/month for 500,000 tokens.
Professional Plus Plan: $249/month for 2.5 million tokens, plus additional features like lead spam score Workflow Action and priority support.
Enterprise Plan: $449/month for 5 million tokens, with the ability to purchase extra tokens.
The terms, pricing, and token usage of each plan are further detailed on AIssistify’s website and are subject to change at AIssistify’s discretion. The purchase of a Service plan constitutes acceptance of these Terms and any applicable conditions set forth on AIssistify’s website.
The Service and all intellectual property rights in the Service are and will remain the exclusive property of AIssistify. Customer shall not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms of the Service.
Customer shall maintain the confidentiality of all information and data related to the Service, and shall not disclose such information to any third party without AIssistify’s prior written consent.
The Service is provided “as is” and AIssistify makes no representations or warranties, express or implied, regarding the Service, including without limitation any warranties of merchantability or fitness for a particular purpose.
AIssistify shall not be liable to Customer or any third party for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Service, even if AIssistify has been advised of the possibility of such damages.
AIssistify may terminate these Terms by providing written notice to Customer. Customer may terminate the Service through the billing self-service portal (serviced by Stripe). After termination notice, the Service will still be provided to Customer until the end of the billing period.
These Terms will be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law.
These Terms constitute the entire agreement between the parties with respect to the use of the Service and supersedes all prior understandings and agreements, whether written or oral, relating to the subject matter of these Terms.
AIssistify may modify these Terms at any time upon written notice to Customer, and Customer’s continued use of the Service after such notice will constitute their acceptance of the modified Terms.
By subscribing to the Service, Customer acknowledges that they have read and agree to be bound by these Terms.
